You are able to apply for Divorce the day after you have lived separately and apart from your spouse for 12 months. If you have not lived apart for 12 months but have been separated even whilst remaining living together, as long as you can provide evidence to the Court of the separation under the one roof, then you may still be able to apply for divorce after 12 months of separation.
