We live in a no-fault Divorce jurisdiction. This means that, ever since the Family Law Act came into force in 1975, only one party to the marriage needs to proceed with a divorce and there’s no requirement to “prove” fault or provide a reason for the irreconcilable breakdown in the marriage. Unlike the US and some other locations overseas where private investigators are required to catch spouses in the act to prove infidelity or other anti-social behaviour, here in the land of Oz one party just calls time on the marriage and 12 months later (provided the marriage has subsisted a total of 2 years) they are able to file for Divorce.
