No not necessarily. It is a factor taken into account in deciding a parenting matter in the Family Law Courts, however the Court are not prevented or limited in deciding that a parent (even one with a Domestic Violence Order taken out against them) is not entitled to spend time with their children. The Family Court will of course have regard to the safety considerations in making any Orders and the circumstances surrounding the domestic violence proceedings will be properly considered by the presiding Judge in determining what parenting arrangement is in the children’s best interests.
