Facebook is not the appropriate forum to “dear diary” post about your divorce. Any post which names your former partner or identifies the Court proceedings or the case generally could fall foul of s121 of the Family Law Act which could lead to punishment. Aside from this, no one can really be assured their “friends” on social media will remain loyal to them and resist the temptation to screen shot any negative post with the ex. This post-share inevitably ends up annexed to the ex’s Affidavit in Court and seen by the Judge. If in doubt, don’t do it and pick up the phone and call someone to vent. Once it is out there “on the online” (you mean online) then its highly likely to be used against you. We are forever reviewing facebook posts our clients provide as evidence of some particular point they wish to make about the ex – don’t put yourself in that position in the first place where the posts may find their way to your opponent lawyer.
