When Child Safety Services (CSS) is concerned your child is unsafe with you, they may seek help from a Court to keep the child safe. When CSS considers a child is in need of protection it may work with the Director of Child Protection Litigation to apply for a Child Protection Order.
A Child Protection Order is a direction from a Court requiring or authorising someone to do or not do something, such as giving CSS the custody or guardianship of a child and authority to place a child in out-of-home care. There are several options available to you if CSS apply for a Child Protection Order for your child.
Some options include:-
- Appealing against a Child Protection Order within 28 days of the order being made; or
- Applying to the Court at any time after the Child Protection Order has been made to have your child returned to your care.
